About these terms
These terms are an agreement between you and DaSkrad Ltd. ("Orshot", "we", "us"), a company registered in England and Wales under company number 16328476. They apply to everything we provide: the orshot.com website, the Orshot app and Studio, the API and SDKs, Orshot Embed, workflows, integrations, agent and MCP connections, and any feature we add later (together, the "Services").
By creating an account or using the Services you accept these terms. If you use Orshot for a company, you confirm you can accept them on its behalf, and "you" means that company. If you do not agree, do not use the Services.
Accounts
You must be at least 18 years old to use Orshot. Orshot is a business service and is not intended for children.
You are responsible for your account, your workspaces, your API keys and access tokens, and everything done with them, including by your team members and by any AI agent or app you connect. Keep your credentials secret and tell us at hi@orshot.com if you think they have been misused.
Plans, billing and credits
Paid plans are subscriptions billed in advance, monthly or yearly, through our payment provider. They renew automatically at the end of each period until you cancel. Prices, plan limits and credit allowances are the ones shown on our pricing page or in your account when you buy. Prices exclude taxes, which are added where required.
Credits are the unit we use to measure usage. Plan credits reset at the start of each billing period and do not roll over. Credits have no cash value, cannot be transferred, and are not refundable except as set out in our refund policy. Credits are only used when a render or generation succeeds.
If you turn on overage or add-ons, you agree to pay for the extra usage at the published rate. Overage is billed after the period in which it happened.
We may change prices or plan contents. For existing subscriptions, we will tell you at least 30 days before a price change takes effect, and it applies from your next renewal. If you do not want the new price, cancel before then.
If a payment fails, we will retry it and let you know. If it still fails, or an invoice (including overage) stays unpaid, we may limit or suspend your account until it is paid.
Refunds and cancellation
Refunds follow our refund policy. You can cancel at any time from your billing settings. Cancelling stops the next renewal; you keep your plan until the end of the period you have paid for, and we do not refund the rest of that period.
Acceptable use
You must not use the Services to:
- break any law, or create or share content that is illegal, defamatory, hateful, harassing, sexually explicit involving minors, or that promotes violence
- infringe anyone's copyright, trademark, privacy or other rights, including using logos, photos, names or brands you do not have permission to use
- impersonate a real person or organization, or create deepfakes, fake reviews, fake documents or fake records meant to mislead
- send spam or run phishing, fraud or scams
- upload malware, probe or attack our systems, get around usage limits, or access other customers' data
- resell or give access to the Services as a standalone product without a written agreement with us
- break the usage policies of the AI providers and platforms the Services connect to
We may remove content, block requests or suspend accounts that we reasonably believe break these rules.
API and fair use
The API is subject to rate limits and usage limits that depend on your plan and may change as we run the service. We may throttle, queue or block usage that is abusive, unusually heavy, or that affects the stability of the Services for other customers, regardless of plan. We will try to contact you first where we can.
We may change or retire API versions, endpoints and parameters. Where a change would break an existing integration, we will give reasonable notice unless the change is needed for security or legal reasons.
AI features
Some features use AI models, including models run by third-party providers. AI output can be wrong, incomplete, similar to other people's output, or unsuitable for your use. It is provided as is and without any guarantee of accuracy, quality, originality or legality. You are responsible for reviewing it before you use or publish it.
You are responsible for your prompts and inputs, and you must have the rights to any images, likenesses, voices, text and brands you give us. You must not use AI features to create content that depicts a real person without their consent or that is meant to deceive.
We choose which models power each feature and may add, replace or remove models at any time. We do not use your content to train AI models. Inputs you send to an AI feature are passed to the provider running that model only to produce your result.
AI agents and connected apps
You can connect AI agents, assistants and other apps to Orshot, for example through MCP, OAuth or an API key. Anything a connected agent or app does with your account counts as your own action. That includes creating and changing templates, spending credits, running workflows and publishing to social accounts. You are responsible for what you authorize it to do, and you can disconnect it at any time.
Third-party services
The Services work with services we do not control, such as social networks, Google, storage providers and automation tools like n8n, Make and Zapier. Your use of those services is governed by their own terms. We are not responsible for them, for their availability, or for changes they make that affect features in Orshot.
Your content
You keep ownership of everything you upload or create, including templates you design, assets, data and the images, PDFs and videos you generate. You give us a license to host, copy, process and display your content only as needed to provide and support the Services for you.
If you share a template publicly or to the community library, you also give Orshot and other users a free, worldwide license to use, copy and adapt that template, and you confirm you have the rights to everything in it.
You are responsible for your content and for having the rights to use it. We do not review content before it is processed, but we may remove content that breaks these terms.
Generated Content Ownership
Any renders generated using Orshot, including any AI-generated visuals or Orshot API generated images, PDFs, or videos, are fully owned by the user who generated them. You retain all intellectual property rights to the content you create and are free to use it for any purpose, including commercial use.
Usage data and feedback
We collect data about how the Services are used, such as request counts, errors and performance. We may use it, in aggregated or anonymized form, to run, secure and improve the Services. It never includes the content of your templates or renders in a form that identifies you.
If you send us suggestions or feedback, we may use them freely without any obligation to you.
Agency & Team Use
Orshot supports agency and enterprise workflows. Account holders on eligible plans may invite external collaborators, including clients and partners, to their workspaces. Each workspace maintains isolated access to its own templates, brand assets, and generated content.
Agency users may integrate Orshot into their internal tools and workflows via the API. Generated content created on behalf of clients is owned by the account holder and their clients as agreed between them. Orshot makes no claim to generated content regardless of who created it.

Website Reads and Brand Information
When you give Orshot a website address, for template ideas or to import a brand, we read that public website. We keep what we find there: the brand's name, logos, icons, colors, fonts, public images, screenshots of the page, and a short description of what the business does. Every workspace that uses the same website shares one copy of this information, so a site is not read again for each person.
Only submit websites you have a right to use, and only use a brand's logos, names and images in ways their owner allows. Reading a website does not give you or Orshot any rights to the brand. We may show public brand information we have read, such as a brand's name, logo and colors, inside Orshot and on public pages.
Brand owners can ask us to correct or remove their brand information at any time by writing to hi@orshot.com. Removed brands are not read or shown again.
Template Ownership & Licensing
Orshot legally owns the templates provided in its library. Users receive a limited license to use these templates in their designs, but ownership remains with Orshot.
You can customize and use them for personal or commercial purposes (subject to restrictions), but you cannot claim full copyright or resell them as-is. Users are prohibited from reselling unmodified Orshot templates or elements.
If you create an original design using only your own uploaded content (no Orshot templates), you own it fully. However, incorporating Orshot templates limits your ownership to the licensed terms.
Apart from your content and the license above, Orshot and its licensors own the Services, the website, the software and all related intellectual property. You may not copy, resell or redistribute them, or reverse engineer the Services.
Orshot Embed
Orshot Embed is an officially supported, iframe-based feature that lets you place the Orshot editor inside your own product under the settings you configure. Outside of Embed, you may not frame the Orshot website or change how it looks without our written permission. You are responsible for how Embed is used on your site and by your users.
Changes to the Services
We are always improving Orshot. We may add, change, limit or remove features, integrations, models and plans at any time. If we remove a major paid feature you rely on, we will tell you in advance where we reasonably can.
Suspension and termination
We may suspend or close your account, immediately and without prior notice, if you break these terms, do not pay what you owe, create a security or legal risk, or use the Services in a way that could harm Orshot, other customers or third parties. In other cases we will give you notice first.
You can cancel your subscription at any time. To delete your account and its data, email us at hi@orshot.com from your account email. We keep your data until you ask us to delete it, except where the law requires us to keep it. Amounts already due remain payable.
Disclaimer
The Services are provided "as is" and "as available". To the extent the law allows, we make no promises that they will be uninterrupted, error-free or fit for a particular purpose, and we exclude all implied warranties. Uptime and support commitments apply only where they are agreed in a signed enterprise agreement.
Limitation of liability
Paid plans. Our total liability to you for all claims relating to the Services is limited to the amount you have actually paid us for the Services.
Free plan. The free plan is provided free of charge, and to the extent the law allows, we are not liable to you for any loss arising from its use.
In all cases, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, business, goodwill or data.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Indemnity
You will defend and compensate Orshot against claims, losses and costs (including reasonable legal fees) brought by third parties that arise from your content, your use of the Services, your use of generated output, or your breach of these terms.
Enterprise & Custom Agreements
These Terms apply to all users by default. Where a separate written agreement (such as a Master Services Agreement, Enterprise Agreement, or Order Form) has been executed between Orshot (DaSkrad Ltd.) and a customer, the terms of that agreement shall take precedence over these Terms to the extent of any conflict, including on liability, service levels and support.
Privacy and cookies
Our privacy policy explains how we handle personal data and cookies. Where we process personal data on your behalf, our data processing agreement applies.
Changes to these terms
We may update these terms. For material changes we will email the account owner at least 30 days before they take effect. If you keep using the Services after that, you accept the new terms. If you do not agree, you can cancel before they take effect.
General
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, unless the law of your country gives you a right to bring a claim elsewhere. If any part of these terms is found unenforceable, the rest still applies. We may transfer these terms as part of a merger, acquisition or sale of our business. Failing to enforce a term is not a waiver of it.
